What is an Enrolled Agent?

History."Enrolled" means EAs are licensed by the federal government. "Agent" means EAs are authorized to appear in place of the taxpayer at the Internal Revenue Service. Only EAs, attorneys and CPAs may represent taxpayers before the IRS. The Enrolled Agent profession dates back to 1884 when, after questionable claims had been presented for Civil War losses, Congress acted to regulate persons who represented citizens in their dealings with the Treasury Department. Enrolled Agents were created by legislation signed into law by President Chester A. Arthur to handle these claims. At the time, some individuals with legitimate claims were cheated by their representative in Washington while on other occasions, the government was being defrauded by false claims. Enrolled Agents were the trusted individuals who would represent petitioners to the US Court of Claims. Later, their work expanded to focus on tax practice.

Professional Proficiency. The Enrolled Agent designation is given to individuals who successfully demonstrate expertise in the field of taxation by sitting for and passing the enrollment examination administered by the Internal Revenue Service. So stringent is this examination, that only about one third of those who take it are able to pass. There are currently less than 35,000 enrolled agents practicing naionally. In fact, Enrolled Agents account for less than 10% of all individuals currently practicing in the field of taxation.

Education.The Enrolled Agent title is the only professional credential issued in taxation at the Federal level. Maintaining the Enrolled agent designation requires a minimum of 72 hours of continuing education every three years. In addition, those EA's like ourselves who are members of the National Association of Enrolled Agents are held to even higher standards and are required to take at least 30 hours per year of CPE in order to maintain membership in the NAEA. This education is narrowly confined to subjects related to taxation in order to maximize an Enrolled Agent's proficiency. The education is closely monitored by the U.S. Department of the Treasury.

What are the Critical Differences Between EAs and Other Tax Professionals?

Only EAs are required to demonstrate to the Internal Revenue Service their competence in matters of taxation before they may represent a taxpayer before the IRS. Unlike attorneys and CPAs, who may or may not choose to specialize in taxes, all EAs specialize in matters of taxation. EAs are also the only taxpayer representatives who receive their right to practice from the United States government. (CPAs and attorneys are licensed by the states.)
